The publication director is the legal representative of the company Terraillon SAS.
The Wellness Coach - MyHealth and Wellness Coach - MySleep applications (hereinafter “Wellness Coach - MyHealth and Wellness Coach - MySleep” or “the Applications”) are governed by French law.
The Applications are hosted on the servers of the company Ecritel, whose registered office is located at 19 rue Alphonse de Neuville, 75017 Paris, with capital of €2,325,000, registered with the Paris Trade and Companies Register under number RCS 332 484 021.
Visitors accessing the Applications from abroad must ensure compliance with locally applicable laws.
As the legal notices may be modified at any time, we invite you to consult them regularly.
- TERMS OF USE OF THE APPLICATIONS:
You may only use these Applications in compliance with these Terms of Use and in any event your use must only be for lawful purposes, that is to say in compliance with all laws, regulations and customs in force in France or in the country from which you access these Applications.
In particular, you agree to:
- Not to publish, transmit or disseminate any harmful, obscene, defamatory or unlawful information either on or from these Applications;
- Do not use these Applications in a manner that may infringe the rights of others;
- Not to use any software, routine or device to interfere or attempt to interfere with the proper working of these Applications, whether manually or electronically, by any means;
- Do not degrade, alter or modify the graphic appearance of these Applications or the software codes constituting them;
- Do not gain or attempt to gain unauthorized access to any of our networks by any means.
Without prejudice to any other rights (whether statutory or otherwise), Terraillon reserves the right to refuse you access to these Applications if it considers (in its sole discretion) that you are in breach of any of the provisions of these Terms of Use.
Terraillon reserves the right to make improvements or changes to the information, services, products and other elements of these Applications, or to close them, at any time, without prior notice. Terraillon also reserves the right to modify these Terms of Use at any time, these modifications being immediately applicable, as soon as they are posted online on these Applications.
Accordingly, by continuing to access or use these Applications, you are deemed to have accepted the modifications to these Terms of Use.
- PROPERTY RIGHTS AND INTELLECTUAL PROPERTY:
Terraillon owns, reserves and retains all property rights, including intellectual property rights, including reproduction rights to Wellness Coach - MyHealth and Wellness Coach - MySleep and the elements they contain.
All patents, logos, texts, layouts, visuals, photographs, graphics, icons and all other distinctive elements contained in the pages of these Applications are the exclusive property of Terraillon.
Pursuant to the law of March 11, 1957 on copyright and the Intellectual Property Code, any reproduction, representation or distribution of all or part of the Applications, by any means whatsoever and on any medium whatsoever, is strictly prohibited without the express prior written authorization of Terraillon or its successors in title or assigns and is liable to legal action, with the sole exceptions referred to in Article L. 122-5 of the Intellectual Property Code and in particular a right of personal, private, individual and non-transferable use of all or part of the Applications.
- DISCLAIMER OF WARRANTY AND LIABILITY:
Contents of the Applications:
Although Terraillon strives to provide reliable content and despite all the care taken in writing the texts and publishing the photographs, errors may remain in the information presented in these Applications. Under no circumstances can Terraillon be held liable for any direct or indirect damages that may result from access to the Applications or the use of the information they present (e.g. errors, omissions, inaccessibility, loss of data, deterioration, destruction or viruses that may affect the user's computer equipment). Consequently, the user acknowledges that they use this information under their sole responsibility and is invited to carry out all necessary checks.
Hyperlinks:
Subject to the mandatory provisions of the Law on Confidence in the Digital Economy No. 2004-575 of June 21, 2004, Terraillon has no means of controlling the content of third-party sites. Terraillon therefore formally declines all responsibility for the content of sites to which links lead. These links are offered to users of the Applications as a service. The decision to activate the links lies exclusively with the users. We also remind you that non-affiliated sites and applications are subject to their own terms of use.
- PERSONAL DATA CHARTER (APPLICATIONS):
By using the Applications, you may transmit personal data about yourself to Terraillon, particularly when creating a user account or subscribing to the Nutrition Wellness Coach Program service.
This charter details Terraillon's commitments regarding the management of your personal data collected through the Applications (the "Charter"). By providing us with your data, you consent to our use of it in accordance with the terms of the Charter and for the purposes detailed below.
Terraillon undertakes to collect and use your personal data entered on the Applications in strict compliance with French and European regulations on the protection of personal data, and in particular to strictly comply with the "Data Protection Act" No. 78-17 of January 6, 1978 and the General Data Protection Regulation No. 2016/679 of April 27, 2016 (known as "GDPR").
5.1 - Nature of the data concerned:
"Personal data" means any data relating to an individual that allows them to be identified. This includes, in particular, names, telephone numbers, postal and email addresses.
"Technical data" means any data that is not considered personal data but is necessary for the proper use of our applications with our products. This includes, in particular, Product activation dates, battery level, Product serial number, and Wi-Fi network. Geolocation permissions and camera access are required for pairing the Products. To display SMS and incoming calls on our fitness trackers, you must authorize access to your contacts, SMS, and calls. This information is not stored in our applications.
5.2 - Uses and recipients of the data collected:
Due to the nature of the products marketed by Terraillon, you are also required to provide Personal Data relating to your well-being, which are necessary for the proper functioning and normal use of the Applications and services provided.
You guarantee the accuracy of the data you provide on the Applications.

- Contractual uses of your data
The collection of your personal data is contractual and is a condition of the conclusion of the contract authorizing you to use the Applications or the services subscribed to through them. This information is used solely within the framework of your contractual relationship with Terraillon and is limited to the data strictly necessary for the service provided.
This data is reserved for strictly internal use by Terraillon and will not be used for any commercial purposes or transmitted or transferred to anyone for commercial or prospecting purposes.
The data collected may be communicated in whole or in part to Terraillon's contractual partners and other recipients of the data involved strictly within the framework of the execution of the service concerned.
As such, the banking information you provide is processed by Terraillon's banking partner. Terraillon does not keep any record of this data.
- Additional uses of your data
Terraillon may also collect data provided by you in the context of using the Applications or subscribing to services through the Applications, in order to:
- create a customer account,
- contact Terraillon customer service,
- subscribe to an advertising information list.
In these cases, Terraillon requires your prior consent to the processing of your personal data which is not necessary for the execution of the sales contract.
Furthermore, Terraillon processes Personal Data concerning you which is not necessary for the execution of the sales contract binding you to Terraillon, subject to your prior consent.
The processing of this data is strictly necessary for the following purposes:
- provide customer support, including services such as warranty and after-sales services;
- facilitate and process your searches and requests for information on Terraillon, its products and services;
- provide you with the latest information regarding Terraillon products and services;
- send you commercial prospecting messages, in particular to find out your opinion on Terraillon products and services and to organize events and other promotional offers
5.5- Transfer of data
Terraillon will only communicate your Personal Data to third parties if you have given your prior consent, or if Terraillon is required to do so, by law or as part of legal proceedings.
Terraillon may possibly share, make available or transmit data to other companies of the Terraillon Group in Europe or outside Europe, it being specified that these companies are directly linked to Terraillon by a capital link (provided that Terraillon strictly complies with the applicable laws regarding commercial and intellectual data protection). Terraillon companies will only use your Personal Data within the limits of the purposes defined below and are or will be subject to strict policies and conditions regarding the use and protection of Personal Data.
In the event of data transfer to Terraillon companies established outside the European Union (“EU”), Terraillon undertakes to comply with the mandatory provisions of the GDPR, and in particular that appropriate guarantees are implemented to preserve the rights and freedoms of users as well as the protection of their personal data in the countries where these companies are located.
Terraillon guarantees that the country located outside the EU in which some of the companies receiving the data may be located is subject to an adequacy decision by the European Commission and therefore provides an adequate level of protection.
In the absence of an adequacy decision, Terraillon guarantees that one or more of the following measures necessary to ensure sufficient protection of the transferred data have been put in place with the recipient company located in the country outside the EU:
- standard contractual clauses (SCCs) of the European Commission;
- internal business rules (BCR);
- standard contractual clauses (adopted by the authorities, considered to be in line with the European Commission's model clauses);
- an approved code of conduct (including a binding and enforceable commitment by non-EU recipients to apply appropriate safeguards),
- an approved certification mechanism (including a binding and enforceable commitment by non-EU recipients to apply appropriate safeguards),
- an administrative arrangement or a legally binding and enforceable text adopted to enable cooperation between public authorities (Memorandum of Understanding known as MOU or MMOU, international convention, etc.), subject to prior authorization from the CNIL;
- ad hoc contractual clauses, subject to prior authorization from the CNIL.
5.6- Data retention
Data will be retained for a period that does not exceed the time necessary for the purposes for which it is collected and processed. After 3 years of inactivity on your account, you will be contacted to see if you wish to keep your account. If you do not respond or do not respond, your account will be deactivated and your data will be deleted.
Furthermore, at any time, if you request the deletion of your user account, we will proceed as soon as possible, upon receipt of your request, to delete the data concerning you.
5.7- Lack of information:
Generally speaking, you cannot visit us on the Applications without having downloaded them or having provided general personal information about yourself.
You can always visit us on the Terraillon website https://www.terraillon.com without being required to provide personal data.
It is mandatory to create an account to access the functions and services of the Applications and the fields marked with an asterisk indicate that certain minimum data is sometimes required. Failure to complete the corresponding input fields may result in Terraillon being unable to provide you with certain access or services.
5.8- Security and confidentiality of data collected:
Terraillon has implemented physical, electronic, and administrative safeguards in compliance with regulations to protect your personal data. This data is only accessible to a limited number of authorized individuals, for the sole purposes indicated above.
5.9- Right of access to personal data:
Any personal information that you may transmit to Terraillon is subject to the provisions of Law No. 78-17 Informatique et Libertés of January 6, 1978 relating to information technology, files and freedoms and to the General Data Protection Regulation No. 2016/679 of April 27, 2016.
As such, you have the right to information, access, rectification, and erasure of personal information concerning you. You may also, for legitimate reasons, object to the processing of data concerning you, exercise a right to object and a right to limit processing, as well as a right to data portability.
Where processing is based on your consent, you may at any time request the withdrawal of your consent, in accordance with the procedures set out above, without affecting the lawfulness of processing based on consent given before its withdrawal.

In the event of difficulties, you have the right to file a complaint with the National Commission for Information Technology and Civil Liberties (“CNIL”).
- RESPONSIBILITY – TECHNICAL PROBLEMS
Terraillon cannot be held responsible for difficulties in accessing or temporary inability to access the Applications linked to disruptions in the telecommunications network, or other technical difficulties.
However, Terraillon undertakes, as far as possible, to inform you of any modification or interruption of the services available on the Applications.
Downloading any material is at your own risk. You remain solely responsible for any damage resulting from such download.
The Applications may contain links to other websites or applications not operated by Terraillon (e.g. Facebook, YouTube, etc.).
Terraillon cannot be held responsible (i) for the provision of these links and (ii) for the content of websites offering hypertext links to the applications or external websites to which a hypertext link is offered on the Applications.
You are expressly informed that the photographs and illustrations of the Applications are for informational purposes only and cannot, in any way, contractually bind Terraillon.
